01The agreement

PackSmart is made and provided by Yağmur Günaydın Öney, an independent developer based in Türkiye ("we", "us"). By using the app you agree to these terms. Our Privacy Policy explains how we handle your data.

If you don't agree, please don't use PackSmart. Apple's and Google's store terms also apply to downloading the app and buying Premium.

02What PackSmart does

PackSmart creates packing lists for trips by plane, bus, train or car, suggests items based on your trip and the people travelling, gives you a Before Leaving Home checklist, sends trip reminders and shows a travel guide for your destination.

You don't need an account: the app creates an anonymous one in the background. The lists are suggestions. What you pack, and what you leave at home, is up to you.

03Travel information is a guide

The travel guide, plug types, voltage, emergency numbers, entry and visa reminders and lost passport steps are general information that we review from time to time. Rules change and every traveler's situation is different, so this information may be incomplete or out of date.

• It isn't legal, immigration, medical or official travel advice.
• Always confirm entry, visa, passport, health and customs requirements with official sources, such as the destination country's government or embassy, your own country's foreign ministry and your airline or carrier.
• We aren't responsible for denied boarding or entry, missed connections, fines, or items you forgot or weren't allowed to bring.

In an emergency, call the local emergency number directly. If the number shown in the app doesn't work, try 112, which works on mobile phones in many countries.

04Reminders

If you turn them on, PackSmart sends a packing reminder a day before you set off and a Before Leaving Home reminder 2.5 hours before departure. Notifications depend on your phone's settings, your internet connection, and Apple's and Google's delivery services, so they can arrive late or not at all.

Reminders are a convenience. Don't rely on them alone for anything important, such as catching a flight or taking medication.

05Your lists and backups

Your lists are saved on your phone. We also keep a backup copy so we can send reminders, and the app may use it to bring your trips back after a reinstall. Because accounts are anonymous, we can't promise this will work, for example when you change phones, and we can't restore your data for you.

The lists, notes and names you create are yours. You're responsible for what you enter, including other travelers' names, and for not putting sensitive information such as passport or card numbers into notes.

06Free plan and Premium

Free plan

• The free plan includes 1 trip. Deleting a trip doesn't give it back.
• All Premium templates are unlocked on your first trip.
• Always free: your packing lists, Before Leaving Home, the travel guide and lost passport steps.

Premium

• Premium is a one-time in-app purchase on the App Store or Google Play. There's no subscription, and the price is shown in the store in your local currency before you buy.
• It unlocks unlimited trips and all templates, and lets you save your own templates and duplicate trips.
• Premium is linked to your App Store or Google Play account. If you reinstall the app or change phones, use Restore purchase with the same store account.
• "Lifetime" means for as long as we offer PackSmart. If we ever shut it down, we'll tell you in the app well in advance.
• Apple or Google processes your payment under their own terms. For a refund, use Apple's or Google's refund process. If a purchase is refunded, Premium is turned off.

Nothing in these terms limits refunds or other rights you have under mandatory consumer law.

07Acceptable use

When you use PackSmart, don't:

• break the law or anyone's rights, including their privacy;
• get around the free plan's limits or the purchase checks, for example with modified apps or scripts;
• copy, reverse engineer, scrape or resell the app, its content or our servers, except where the law allows it;
• overload or attack our systems, or test their security without our written permission.

08Availability and changes

We work hard to keep PackSmart running, but we can't promise it will always be available or free of errors. Most of the app works offline; backups and reminders need an internet connection and our servers.

We may change, add or remove features. If a change significantly affects something you've paid for, we'll tell you in advance.

09Intellectual property

• PackSmart, its name, design, code, templates and content belong to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for your own non-commercial purposes.
• Your lists stay yours. You let us store and process them only to run the backup and reminders, as described in the Privacy Policy.

10Other companies' services

PackSmart relies on services from Apple, Google and RevenueCat. Their own terms apply when you use their services, and we're not responsible for them.

11Liability

• PackSmart is provided "as is" and "as available". As far as the law allows, we make no promises about the completeness of lists or travel information, the delivery of reminders, or the app running without interruption.
• As far as the law allows, we're not liable for indirect or consequential losses, or for travel plans, bookings or decisions you make based on the app.
• As far as the law allows, our total liability to you is limited to the amount you paid for Premium.
• None of this limits liability that can't legally be limited, such as for intent, gross negligence, or death or personal injury, and it doesn't affect your rights as a consumer.

12Ending your use

You can stop using PackSmart at any time. To have your backup deleted from our servers, email us as described in the Privacy Policy.

We may suspend or close your access if you seriously or repeatedly break these terms or the law, or to protect other people.

Parts of these terms that by their nature should continue, such as the liability section, still apply afterwards.

13If you got PackSmart from the App Store

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Your licence is to use PackSmart on Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to meet any applicable warranty, you can tell Apple, and Apple may refund the purchase price. As far as the law allows, Apple has no other warranty obligation for the app.
• Apple isn't responsible for handling any claims relating to the app, such as product liability claims, claims that it fails to meet a legal or regulatory requirement, or consumer protection, privacy or similar claims.
• If someone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you aren't located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you aren't on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14Changes to these terms

We may update these terms. We'll change the date at the top, and for important changes we'll tell you in the app before they take effect. If you keep using PackSmart after that, the new terms apply. If you don't agree, you can stop using the app.

15Law and disputes

These terms are governed by the laws of the Republic of Türkiye. If you're a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.

If you live in Türkiye, you can apply to the consumer arbitration committees within the legal monetary limits, and to the consumer courts above them.
